LINCOLN— The University of Nebraska is working to comply with a federal court ruling requiring it to charge out-of-state tuition to students who are in the U.S. without legal status. In June, U.S. District Judge Brian Buescher ruled that Nebraska's law allowing those students to receive in-state tuition violates federal law. Although the decision is being appealed, the ruling remains in effect, requiring the university to change its residency verification process.

University officials are developing a system to verify students' U.S. citizenship or other qualifying legal status, potentially using federal financial aid records, passports, or birth certificates. Previously, the university did not collect students' immigration status and only required proof of Nebraska residency. With fall tuition deadlines approaching, it remains unclear whether the new verification procedures will be fully implemented before tuition bills are issued and payments are due.
